Linden Title, LLC - Terms of Service

By purchasing any product or service from Linden Title, LLC ("Company"), you ("Purchaser") acknowledge and agree to be bound by these Terms & Conditions, which take effect immediately upon purchase. If you do not agree, please refrain from using our services, or contact us for a custom engagement.

2. Scope of Services

Linden Title, LLC provides title research services, including but not limited to Telecom Title Reports, Ownership & Encumbrance (O&E) Reports, and Title Watch monitoring. These services are provided on a non-exclusive basis and are for informational purposes only. They do not constitute legal advice, title insurance, or a guarantee of title status. The Company may engage subcontractors to fulfill certain service requests.

3. No Legal Advice or Title Insurance

Linden Title, LLC is not a law firm and does not provide legal services. Our reports should not be relied upon as legal advice or as a substitute for title insurance. Clients should seek legal counsel for property-related matters.

4. Turnaround Time Guarantee

For Telecom Title Reports and O&E Reports, we guarantee a 7-day turnaround for orders of five (5) or fewer reports placed within a 7-day period. If we fail to meet this timeline (excluding District Court searches and bulk orders exceeding five reports per week), we will provide a 25% discount on the affected report.

5. Title Watch Service

Title Watch is a monitoring service that provides alerts for recorded changes to the specified property. It does not verify ownership or provide legal interpretation. The service is available for a monthly subscription fee of $20 per property. Subscribers must provide accurate property details, and the Company is not responsible for discrepancies in public records.

6. Pricing & Payment

Telecom Title Report: $750 per report.
Ownership & Encumbrance Reports: Pricing as specified at the time of order.
Title Watch Subscription: $20 per month per property.
Bulk discounts are available for 6+ reports.
Payments must be made at checkout or per agreed-upon terms for bulk clients.
Unless prepaid, Subscription fees for Title Watch are billed on a recurring basis, and failure to make timely payments may result in suspension or termination of service.

7. Refund & Cancellation Policy

All sales are final. Refunds and cancellations are not permitted once work has commenced. Exceptions may be considered on a case-by-case basis at the sole discretion of Linden Title, LLC.

8. Confidentiality, Non-Disclosure, and Conflict of Interest

All work-related information, client data, and communications shall be treated as confidential by Linden Title, LLC and its subcontractors. Confidentiality obligations shall remain in effect for twelve (12) months following the completion of services.

9. Limitation of Liability

Linden Title, LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our reports or services. The maximum liability for any claim shall not exceed the fee paid for the service.

10. Service Availability

Reports and monitoring services are available nationwide; however, service availability is subject to local record accessibility. Clients are encouraged to verify service availability for their area before placing an order.

11. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflicts of law principles.

12. Dispute Resolution

Any disputes arising under or related to these terms shall be resolved through mediation in Colorado. If mediation is unsuccessful, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

13. Force Majeure

Linden Title, LLC shall not be responsible for delays in performance or non-performance due to unforeseen circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, or technological failures.

14. Amendments

Linden Title, LLC reserves the right to modify these Terms & Conditions at any time without prior notice. Continued use of the services after modifications constitutes acceptance of the revised terms.
